New York DWI Laws

In order to get charged with DWI in New York State, your blood alcohol content (BAC) must be .08 percent or higher, or there is other evidence of impairment. However, if you are a commercial driver’s license (CDL) holder, having a BAC of at least .04 can lead to a DWI arrest.

If your BAC is at least .18 percent, then you could be charged with Aggravated DWI. On the other hand, if your BAC is over .05 percent but less than .07 percent, you could be charged with driving while ability impaired by alcohol (DWAI-Alcohol).

If your driving ability was impaired by a single drug, you will be charged with DWAI-Drug. If your driving ability was impaired by a combination of alcohol and drugs, you will be charged with DWAI-Combination.

If you are under 21 years old and drive with a BAC of at least .02 percent, you will be charged with an underage DWI based on the state’s zero tolerance law.
